What is Alimony?

Depending on the circumstances, these payments may be ordered during the divorce process or post-divorce, depending on the circumstances. Massachusetts law does not guarantee spousal support. Alimony’s structure and duration depend on various factors. Instead, alimony is granted only when a court finds it appropriate, based on the specifics of the case.

Understanding the Four Types of Spousal Support in Massachusetts

Massachusetts law recognizes several forms of spousal support, each designed to address different circumstances within the divorce process. Specifically, there are four main types of alimony that may be awarded:

  • General Term Alimony: This form of alimony is awarded to a spouse who is economically dependent on the other. Typically, the amount and duration are determined by various factors, including the length of the marriage and each spouse’s financial circumstances.
  • Rehabilitative Alimony: Intended to assist a spouse in achieving financial independence, rehabilitative alimony may be awarded as a lump sum or in a series of payments. In many cases, this support helps the dependent spouse gain the necessary skills or resources to become self-sufficient.
  • Reimbursement Alimony: This type of alimony is designed to compensate a spouse for economic or non-economic contributions made during the marriage. For example, it is often awarded when one spouse supports the other’s education or career, allowing them to achieve greater financial success.

  • Transitional Alimony: Aimed at helping a spouse adjust to life post-divorce, transitional alimony may cover costs such as relocation, initial living expenses, or other transition-related needs. Unlike general-term alimony, it is typically awarded for a limited period.

What to Know About Massachusetts Guidelines for General Term Alimony

Under Massachusetts law (MGL c.208, § 49(b)), there are specific guidelines in place to help judges in the Suffolk County Probate and Family Court determine the appropriate duration of general term alimony. Generally speaking, the length of alimony is primarily influenced by the length of the marriage, as outlined below:

  • Marriages of 5 years or less: Alimony may be awarded for up to half the length of the marriage.

  • Marriages of more than 5 but 10 years or less: Alimony may be awarded for up to 60% of the length of the marriage.

  • Marriages of more than 10 but 15 years or less: Alimony may be awarded for up to 70% of the length of the marriage.

  • Marriages of more than 15 but 20 years or less: Alimony may be awarded for up to 80% of the length of the marriage.

  • Marriages of more than 20 years: There is no specific limit; indefinite alimony may be awarded in certain circumstances.

How Courts Determine Alimony

In Massachusetts, alimony follows no fixed rule. Instead, it depends on a thorough evaluation of each case’s unique circumstances. In addition to the duration of the marriage, courts will examine several factors when deciding alimony, including:
