Understanding Alimony

Alimony, also referred to as spousal support or spousal maintenance, is financial support that one spouse may be required to pay to the other during or after a divorce. Massachusetts recognizes multiple forms of alimony, each designed to address different financial situations. Unlike child support, alimony is not automatically granted; instead, it is awarded based on the specific circumstances of the marriage and the financial needs of each party.

Types of Alimony in Massachusetts

Massachusetts law provides for four distinct types of spousal support, each serving a different purpose. The type and duration of alimony awarded depend on various factors, including the length of the marriage and each spouse’s financial situation.

  • General Term Alimony: General term spousal support is the type of alimony that most people think about. Specifically, it consists of ongoing payments made by the financially-advantaged party to their former spouse. The amount and duration of general term alimony depends on the length of the marriage, the specific financial circumstances, and other material factors.
  • Rehabilitative Alimony: This temporary form of support is designed to assist a spouse in becoming financially independent after a divorce. It is often awarded to help a spouse complete education or job training.
  • Reimbursement Alimony: Reimbursement alimony is designed to repay a spouse for costs that they incurred in order to help the other spouse. As an example, imagine that one partner worked full-time while the other attended law school. The spouse who worked may be entitled to reimbursement alimony for their contributions.

  • Transitional Alimony: Transitional alimony is designed to help the financially-vulnerable spouse transition into their new life after a divorce. For instance, it could cover things like moving expenses and initial rent payments.

Alimony Guidelines in Massachusetts

Under Massachusetts law (MGL c.208, § 49(b)), there are specific guidelines in place to help courts determine the proper duration of general term spousal support. Here is an overview of the Massachusetts guidelines for the length of general term alimony—

  • Marriage of 5 years or less: Alimony may last up to 50% of the marriage’s duration.
  • Marriage between 5 and 10 years: Alimony may last up to 60% of the marriage’s duration.
  • Marriage between 10 and 15 years: Alimony may last up to 70% of the marriage’s duration.
  • Marriage between 15 and 20 years: Alimony may last up to 80% of the marriage’s duration.
  • Marriage over 20 years: There is no maximum duration, and alimony may be indefinite.

An Overview of Factors Courts Consider in Alimony Decisions

Judges evaluate multiple factors when determining alimony awards, including:

  • The length of the marriage
  • Each spouse’s current and future financial prospects
  • Contributions made to the marriage, including non-financial contributions
  • Any misconduct that contributed to the divorce
